    Terms of Service

    1. Acceptance of the Terms

    By accessing and using the Xivalo platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you must not use the Service. Continued use of Xivalo constitutes full acceptance of these terms and of any subsequent amendment.

    2. Description of the Service

    Xivalo is an AI-powered meeting intelligence platform. The Service allows you to record, transcribe, and analyse meetings held over Zoom, Google Meet, and Microsoft Teams, providing automated summaries, task detection, key topic identification, and other analytical features.

    3. Registration and Account

    To use Xivalo you must create an account and provide accurate, up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out under your account. Accounts are personal and non-transferable. You must notify Xivalo immediately of any unauthorised use of your account.

    4. Plans and Billing

    Xivalo offers a free plan with limited functionality. Paid plans (Pro, Team) are billed monthly or annually depending on the option selected. Payments are processed securely through Stripe. Xivalo reserves the right to change prices, giving users at least 30 days' notice. Cancellations take effect at the end of the current billing period.

    5. Acceptable Use

    By using Xivalo, you agree not to:

    • Use the Service for unlawful or unauthorised purposes.
    • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
    • Distribute malware, viruses, or other malicious code through the platform.
    • Violate the privacy of others by recording meetings without the consent of the participants.
    • Overload or interfere with the Service's infrastructure.
    • Resell or redistribute access to the Service without express authorisation.

    6. Recording and Consent

    You are solely responsible for obtaining the consent of all meeting participants before starting a recording. Xivalo provides the technical tool for recording but assumes no responsibility for compliance with the privacy regulations applicable in each jurisdiction. It is your obligation to inform participants that the meeting will be recorded and processed using artificial intelligence.

    7. Intellectual Property

    You retain all ownership rights over your content, including recordings, transcripts, and any material generated from your meetings. Xivalo retains all rights over the platform, its technology, brand, design, and source code. By using the Service, you grant Xivalo a limited licence to process your content solely for the purpose of providing the service you signed up for.

    8. Artificial Intelligence Processing

    Recordings are processed using artificial intelligence models for transcription (Deepgram), and for analysis and summary generation (OpenAI). By using the Service, you expressly consent to this processing. Data sent to these providers is processed under a Data Processing Agreement, and none of them uses API data to train their models.     9. Limitation of Liability

    Xivalo provides the Service "as is" and "as available", without warranties of any kind, whether express or implied. Xivalo shall not be liable for indirect, incidental, special, consequential, or punitive damages. Xivalo's maximum liability is limited to the total amount of fees paid by the user during the 12 months preceding the event giving rise to the claim.

    10. Termination

    Either party may terminate the relationship at any time. You can cancel your account from your profile settings. Xivalo reserves the right to suspend or terminate accounts that breach these terms. After account deletion, user data is retained for a maximum of 30 days before permanent deletion.

    11. Amendments

    Xivalo reserves the right to amend these Terms of Service at any time. Amendments will be communicated by email at least 30 days in advance. Continued use of the Service after the amendments take effect constitutes acceptance of the new terms.

    12. Governing Law and Jurisdiction

    These Terms of Service are governed by Spanish law. For the resolution of any dispute arising from these terms, the parties submit to the jurisdiction of the Courts and Tribunals of Madrid, Spain, expressly waiving any other jurisdiction that might apply.
